What is Conveyancing?
Conveyancing is the transfer of property from one person or entity to another.
Conveyancing includes investigating the title of the property in order to ensure that it is not adversely affected by certain matters, such as proposals by government departments, illegal buildings, outstanding rates or any orders for work to be done which have not been complied with. -
What are Disbursements?
Disbursements are monies paid out by Conveyancing Melbourne Suburbs to obtain information about the property from Authorities. Disbursements will differ depending if you are a seller or a buyer.
Disbursements include;- Title Search
- Building Certificate
- Land Information Certificate
- Water/Encumbrance Certificate
- Planning Certificate
- Roads Certificate
- Land Tax Certificate
- Body Corporate (if applicable)
Don't forget when we quote you for our services we have quoted our cost which will include disbursements & GST. -
What are Adjustments?
The adjustment of rates will ensure that the Vendors pay all rates and taxes due on the property up until settlement date.
The adjustments will also allow the vendor to pay any arrears and/or outstanding interest on the rates and charges together with fees pertaining to the discharge of any mortgage or caveat. -
What occurs at Settlement? and do I need to attend?Settlement is the process where all parties to a conveyancing transaction come together to complete the transaction. The parties that attend settlement are the Vendor's and Purchaser's Representatives and Mortgagees.
At settlement documents and cheques are exchanged between all parties, once good title has been established and all parties are satisfied, settlement is deemed to have been effected. The Vendor/Purchaser are contacted by telephone by their representative to be advised settlement has occurred.
Usually keys are left with the Agent (unless other arrangements have been made) and the Purchaser would collect keys from the Agent as soon as receiving the call that settlement has occurred.
It is not usual for a Purchaser or Vendor to attend settlement, but our firm is happy to advise you of location and time of settlement should you wish to attend. -
What is Stamp Duty?Stamp Duty is a tax imposed by the Victorian Government on the purchase of a property in Victoria. Under the standard Contract of Sale, Stamp Duty is payable by the buyer. It is determined by the purchase price of the property together with any concession you may be entitled to.

Are we required to attend your office?No you are not required to attend our office, of course you are most welcome to come in, but all Conveyancing can be completed by mail, fax, email & phone.

Finance and your lender
If your contract is conditional upon the approval of finance, you must ensure you make immediate application for your loan and do anything reasonably asked of you by your lender to secure approval.
It is the purchaser’s responsibility to advise the vendor if finance has or has not been approved or has been declined, by the approval date.
Therefore it is essential that you contact us by the approval date specified in your contract, regardless of whether or not your finance has been approved.
If you do not advise the vendor that finance has not been approved, the usual finance clause will allow the contract to become unconditional. It is critical that you ensure that we are made aware of any delay or problem with finance approval.

What is Professional Indemnity Insurance?Pursuant to Section 330(1) of the Legal Practice Act 1996. This firm holds Professional Indemnity Insurance against civil liability in connection with all Conveyancing work performed in the course of this business. Further details including a copy of the Insurance Policy Schedule, amount of cover and any relevant exclusions on the cover may be obtained upon request.
