The Sale Process


Conveyancing Melbourne Suburbs uses a comprehensive checklist of the activities and documents that are necessary to complete a sale.
We provide you with an overview of tasks we complete once we have been instructed to act on a Vendor’s behalf:-
  • Conveyancing Melbourne Suburbs obtains by telephone from the Vendor answers to a series of questions in relation to the property to enable preparation of Section 32 Vendor Statement & Contract of Sale.
  • Conveyancing Melbourne Suburbs conducts a search of Title including subdivision and any encumbrances, caveats or notices.
  • Conveyancing Melbourne Suburbs orders Certificates including:- Land Information Certificate, Water/Encumbrance Certificate, Planning Certificate, Roads Certificate & Owners Corporation Certificate (if applicable).
  • Conveyancing Melbourne Suburbs prepares Section 32 Vendor Statement & Contract of Sale.
  • Conveyancing Melbourne Suburbs sends copies of Section 32/Contract of Sale in quadruplicate to Vendor’s Estate Agent.
  • Conveyancing Melbourne Suburbs sends out an initial letter to Vendor enclosing Discharge Authority & Section 27 Statement in readiness for sale.
  • Conveyancing Melbourne Suburbs will attend to writing to the Mortgagee advising that the property has sold, advising settlement date and requesting Mortgagee prepare discharge documentation and also a letter of confirming of Section 27 details to assist with the release of deposit.
  • Conveyancing Melbourne Suburbs attends to sending Section 27 to Purchaser’s Representative for signature by the Purchaser to enable release of the deposit. (Please note that the Purchaser will not sign the Section 27 statement until a confirmation letter from your mortgagee has been provided).
  • Conveyancing Melbourne Suburbs answers Requisitions on Title & forwards same to Vendor for confirmation & signature (only if applicable).
  • Conveyancing Melbourne Suburbs prepares Statement of Goods Transferred with Residential Land and sends same to the Vendor for signing together with the Transfer of Land.
  • Conveyancing Melbourne Suburbs sends answers to Requisitions to Purchaser’s Representative (if applicable).
  • Conveyancing Melbourne Suburbs requests the Agent in writing to release balance of deposit after the deduction of their commission only if a Section 27 Statement has been signed by the Purchaser and certain conditions are met.
  • Conveyancing Melbourne Suburbs attends to cross checking Statement of Adjustments and Settlement Statement which is provided by the Purchaser’s Representative.
  • Conveyancing Melbourne Suburbs obtains from the Vendor confirmation that Adjustments are correct in that the rates are either paid or unpaid.
  • Conveyancing Melbourne Suburbs attends to booking settlement with the Purchasers Representative & Lender.
  • Conveyancing Melbourne Suburbs advise’s Purchasers Representative in writing of cheque details required for settlement and confirming settlement arrangements.
  • Conveyancing Melbourne Suburbs contacts the Water Authority to request a final reading.
  • Conveyancing Melbourne Suburbs attends to settlement.
  • Conveyancing Melbourne Suburbs attends to telephoning Client & Agent (also in writing) advising settlement has occurred.
  • Conveyancing Melbourne Suburbs prepares a Notice of Disposition and arranges for the notice to be sent to the Council & Water Authority.
  • Conveyancing Melbourne Suburbs attends to sending a final letter to the Vendor which will include a statement of monies involved, enclosing copies of Statement of Adjustments & enclosing our account.
  • Conveyancing Melbourne Suburbs banks cheques on behalf of the Vendor into their nominated account if Vendor does not want to collect or have cheques posted.
